Terms of Use

These terms are an agreement between you and Jon Flaherty, an individual (“we”, “us”), the operator of Vantage: the app at shootvantage.com and the Vantage iOS app (together, the “Service”). By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
- Vantage is a guide. Conditions, hours and access change. Your safety, and staying within the law where you shoot, are your responsibility.
- Post only your own photos, and nothing offensive. We have zero tolerance for objectionable content and abusive users.
- You keep ownership of your photos and give us permission to show them in Vantage.
1. Accounts
- You must be at least 13 years old to use Vantage. If you are under the age of majority where you live, you need a parent’s or guardian’s permission.
- Use an email address you control, keep your password to yourself, and tell us if you think someone else has accessed your account. You are responsible for activity on your account.
- One person per account. Do not create accounts in bulk, by automated means, or in someone else’s name.
2. A guide, not a guarantee
Vantage describes places and predicts light, sun and moon positions, weather, sky conditions and tides. Predictions are estimates and can be wrong. Opening hours, fees, rules and access are checked but change without notice, so confirm before a special trip.
You are responsible for your own safety and for following the law. In particular:
- Obey posted rules, closures and opening hours. Do not trespass. Respect private property and the privacy of people you photograph.
- Get any permits you need, for example for commercial shoots, tripods in restricted areas, or drones.
- Take care with tides, water, cliffs, weather, wildlife, traffic and darkness. Never rely on Vantage for your safety.
3. Community rules
Shots you add to a spot are visible to everyone using Vantage. We have zero tolerance for objectionable content or abusive users. When you post:
- Post only photographs you took yourself.
- Nothing offensive — no nudity, gore, hate, or harassment.
- Keep it about the place: a shot from the spot, not an advert.
- No people who would object to being posted, and no children.
Anyone can report a shot. Two independent reports hide it straight away, and a curator reviews every report, normally within one business day. You can also block a photographer: their shots disappear for you immediately. We remove content that breaks these rules, and we suspend or close the accounts of people who post it or abuse others. The same rules are in the app under Settings → Community guidelines.
4. Your content
- You keep ownership of the photos, notes, comments and other content you submit.
- By posting a shot to a spot, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, and display it to other users within the Service, and to sublicense those rights to the providers that run the Service for us. You can end this licence for a shot by deleting it; deleting your account deletes all of your shots.
- You confirm that you own or have permission to share what you post, that identifiable people in it have agreed, and that posting it does not break any law or anyone else’s rights.
- We may remove any content at our discretion, including content that breaks these terms.
- Copyright complaints: if you believe a shot on Vantage infringes your copyright, report it in the app or email support@shootvantage.com with the shot’s location, your contact details, and a description of the work.
5. Client shortlists
Photographers can send clients a link to a shortlist of spots. Anyone with the link can open it, without an account. You are responsible for who you share links with and for what you write in them. If you answer a shortlist as a client, your picks, name and comment go to the photographer who sent it.
6. Acceptable use
Do not:
- scrape, copy or republish the spot guides or other users’ photos in bulk;
- interfere with the Service, probe it for vulnerabilities without permission, or get around its limits or security;
- send spam or automated submissions through feedback, suggestions, shortlists or reports;
- fake your location or photos to earn points or complete hunts;
- impersonate anyone, or use the Service to harass, threaten or harm anyone;
- use the Service for anything unlawful.
7. Our content and credits
The Vantage name, logo, app, spot guides, craft notes and curation are ours or licensed to us, and you may use them only through the Service. Some spot photos come from Wikimedia Commons, Flickr and other sources under their authors’ licences, credited on each photo. Map data is © OpenStreetMap contributors. Weather data is from Open-Meteo (CC BY 4.0).
8. Feedback and suggestions
If you send feedback or suggest a spot, we may use it to improve Vantage without owing you anything for it.
9. Changes and ending
- Vantage is free today. We may add, change or remove features. If we introduce paid features, we will tell you the price before you pay anything.
- You can stop using Vantage at any time and delete your account in Settings → Account → Delete account (see Support).
- We may suspend or close your account if you break these terms, if we are required to by law, or if we stop offering the Service. Sections 10 to 13 continue after your account ends.
10. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that any prediction, place description, hour, fee or access rule is accurate.
11. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service or of any place you visit because of it. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places do not allow these limits, so they may not all apply to you; nothing in these terms limits liability that cannot be limited by law.
12. Indemnity
If you break these terms or the law, or post content that infringes someone’s rights, you agree to cover our reasonable costs of any resulting claim against us, to the extent the law allows.
13. Governing law
These terms are governed by the laws of the State of Florida, USA, and disputes will be resolved in the courts of Hillsborough County, Florida, except where the law of the country you live in gives you the right to bring claims at home.
14. Apple App Store terms
If you use the Vantage iOS app, these additional terms apply:
- These terms are between you and us, not Apple. Apple is not responsible for the app or its content.
- Your licence to use the app is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, and claims that it infringes someone’s intellectual property.
- You confirm you are not located in a country subject to a US government embargo or designated as supporting terrorism, and are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
15. Changes to these terms
We may update these terms. We will change the date at the top, and for material changes we will tell you in the app or by email before they take effect. If you keep using the Service after that, the new terms apply.
